The owners of food truck known as "The Wandering Dago" are suing the state over the business getting kicked out of the Saratoga Race Course this summer. After oral arugments at federal court today, Wandering Dago's attorney George Carpinello read an email he says indicates the decision was made over the business's name by Deputy Secretary of Gaming and Racing Ben Liebman.

Carpinello says there's no written policy giving the state the power to exclude them from the track. He's also arguing the state violated their free speech rights by denying them a permit to operate at the Empire State Plaza.
