The attorney for the man charged in connection with a deadly crash in Lake George is asking for the indictment against his client to be thrown out.
He says statements made to police by Joseph Futia should not be allowed because Futia has no recollection of what happened. Futia is accused of being under the influence of alcohol and drugs when he hit and killed Jamie Persons and Quentin Delgadillo on a bike path last year. Futia was recently given the chance to plead guilty in exchange for a sentence of no more than 20 years to life in prison but turned down the offer.
