Hudson Valley Woman Arrested for Topless Gardening

A woman from Hudson Valley is suing the Village of Red Hook because she says her right to garden while topless was infringed upon.

30-year-old Jenica Igoe says police instructed her to cover her nipples while gardening outside her home, which she did, however police then stopped by again and arrested her.

Once in court however, a judge threw out the case because since 1992, it's been legal in the state of New York for women to go topless in public.

Igoe says she prefers to garden topless because of the heat. She's now suing the village and seeking unspecified damages.
