Criminal Charges May be Reinstated Against Rensselaer County DA Abelove

The Attorney General's office wants a judge to reinstate criminal charges against Rensselaer County DA Joel Abelove.

A felony perjury charge and two misdemeanor charges of official misconduct were dismissed in June by Acting State Supreme Court Justice Jonathan Nichols.

The dismissal comes in connection with Abelove's actions following the 2016 police-involved shooting of Edson Thevenin, but Nichols ruled that indicting Abelove went beyond Gov. Cuomo's executive order appointing a special prosecutor to investigate that case. 

The AG's office says Abelove lied to a grand jury to protect himself from being prosecuted for misconduct. 

Abelove was defeated in his re-election effort by Democrat Mary Pat Donnelly.
