SUNY Official Avoids Jail But Gets Restitution & Probation for Misconduct

Restitution and probation, but no jail time for a former SUNY official who bilked the system.

David R. Smith admits Official Misconduct while he was President of SUNY Upstate Medical University. 

The Attorney General's and Inspector General's offices say Smith came up with several  methods to pad his pay including directing a subordinate to approve an unauthorized raise that over about six years netted him about $190,000 extra pay. 

Smith has paid back $75,000 but has $175,000 to go over the next three years. 

If he doesn't, Smith could face up to three years in jail.
