In one of its first actions after approving the state budget, the State Senate voted to approve the measure Monday.
The Assembly voted last month to raise the age to buy tobacco products from 18 to 21.
Gov. Cuomo issued a statement late in the day commending lawmakers for the measure, and says he looks forward to signing what he calls "this life-saving legislation."
Over the past couple of years, over a dozen counties, including Albany and Schenectady, have approved similar laws.
