Albany Man Released on Manslaughter Charge Now Faces Upgraded Murder Charge

An Albany man released from prison under New York's new bail reform laws has now been charged with murder. A grand jury has indicted Paul Barbaritano, who is accused of killing Nicole Jennings in a Brevator St apartment last July. Barbaritano was released because, under the new law, the previous charge of 2nd degree manslaughter does not meet the criteria for him to be locked up pending trial.

He has a Wednesday court appearance. Once arrested, the upgraded charge would qualify Barbaritano to be held under bail conditions.

At the time of his release, Barbaritano's attorney says he was trying to save Jennings' life following a consensual sexual encounter.
